VisionToU Terms of Service

Welcome to VisionToU. These Terms of Service ("Terms") govern your access to and use of the VisionToU mobile application, website, and related services (collectively, the "Service"). The Service provides creative AI features including image-to-image generation, image-to-video creation, custom text-and-visual video production, and AI-powered filters.

Please read these Terms carefully. By accessing or using the Service, you confirm that you understand and agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Accounts and Access

You may use some Service features without registering an account. If you create an account, you are responsible for keeping your credentials confidential and for all activity under that account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. If we discover that a user is under the required age, we may terminate the account and delete related data.

2. Acceptable Use and Your Responsibilities

You agree to use the Service within the scope permitted by law and with respect for others.

Prohibited Conduct

You must not:

• Use the Service in violation of any applicable laws, regulations, or the rights of third parties;
• Upload, generate, or share content that is illegal, abusive, harassing, threatening, hateful, pornographic, or that infringes on intellectual property or privacy rights;
• Attempt to damage, reverse engineer, or gain unauthorized access to our systems or networks;
• Use the Service for any commercial purposes without our prior written consent.

AI-Generated Content

Our AI features are creative tools. You are responsible for all content you input, generate, or share using VisionToU, including ensuring that it complies with these Terms and does not infringe the rights of others. You must not use our AI features to create deceptive, misleading, or harmful content, including malicious deepfakes or content that impersonates others without consent.

3. Intellectual Property Rights

Our Ownership

VisionToU, including its software, designs, trademarks, logos, and underlying AI models and algorithms, is the property of VisionToU or our licensors and is protected by intellectual property laws.

Your Content

You retain ownership of the original photos, videos, and text prompts you upload or input into the Service ("Your Input Content").

License Granted to Us

To operate and improve the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process Your Input Content solely for the purpose of providing the Service to you (e.g., generating the output you request). This license also permits us to use anonymized and aggregated data to improve the Service and train AI models.

AI-Generated Output

Subject to your compliance with these Terms, you own the original and unique visual or video outputs generated for you by the AI based on Your Input Content ("AI Output Content"). This ownership does not extend to the underlying technology, methods, or any pre-existing elements contained in the AI Output Content.

4. Disclaimers and Limitation of Liability

Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis. We disclaim all express or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

AI Disclaimer

AI technology is experimental and may produce inaccurate, incomplete, or unexpected results. We make no warranties regarding the accuracy, reliability, or quality of any AI Output Content. You assume all risks arising from the use of AI-generated content.

Limitation of Liability

To the fullest extent permitted by law, VisionToU and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or in connection with your use of the Service. Our total aggregate liability for any claims arising out of these Terms shall not exceed the amount you have paid to us in the preceding twelve (12) months, if any.

5. Prohibited Content

You may not upload, generate, share, or distribute content that includes:

• Sexual or NSFW content: Explicit sexual acts, pornography, nudity involving minors, or content intended for sexual exploitation or arousal.
• Violence or harmful content: Graphic violence, gore, mutilation, self-harm or suicide-related content, or abuse of people or animals.
• Hate speech and harassment: Content that promotes hate or discrimination based on race, religion, gender, nationality, identity, or other protected characteristics, including threats or abusive behavior.
• Political or public figure manipulation: Misleading political content, deceptive deepfakes or manipulated media involving public figures, or content intended to unlawfully influence elections or public opinion.
• Illegal or fraudulent content: Forged documents, scams, impersonation, deceptive practices, or content connected to illegal activity.
• Intellectual property or privacy violations: Content that infringes copyrights, trademarks, privacy rights, or publicity rights, including generating or uploading images of individuals without appropriate consent.

6. Service Changes and Termination

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also suspend or terminate your access to the Service if you breach these Terms. Upon termination, your right to use the Service ceases immediately, while the provisions relating to intellectual property rights, disclaimers, and limitation of liability shall remain in full force and effect.

7. General Provisions

These Terms constitute the entire agreement between you and VisionToU with respect to the Service. If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
